If you will review the Public Records Request I sent to Ms England on Oct 6, 2011, I did NOT request Ms England to forward to me the e-mail she forwarded to rupe. I DID request the following from Ms England:

"2) Copy of any invoice given rupe for the time/effort spent to do the PRR for the Sep. 7, 2011 e-mail.
"3) Copy of "standing order" PRR from rupe that requests that any e-mails from Linda McKinney to the BOCC or Brevard County in general be forwarded to rupe; and date of commencement of "standing order".

I requested Ms England send the Public Records Request "from YOUR computer, from YOUR files."  I STILL request a COPY of the PRR that rupe submitted to the D1 office that would have given Ms England the instruction to forward my e-mail to rupe. I request it whether it be in the form of an e-mail, fax, memo, notes taken from a voice conversation, personal reminder, calendar event, sticky note, fly's wings, whether it's written in gum on the bottom of a shoe, I request to physically see a copy of the Public Records Request rupe submitted that got her the e-mail all this hassle has been about. It is my RIGHT under FL SS 119 to receive it and I WILL receive it one way or another, or there will be an admission made that there was no PRR and that Ms England acted without such a request.
 
Unfortunately, IF this be the case, she either acted in the interests of rupe, performing a personal favor for rupe, and then trying to hide the fact via not responding to my Public Records Request that I sent to all Commissioners' offices simultaneously. This is the second PRR request for a copy of rupe's request. FL SS 119 is perfectly clear as to what should happen. Denying me only endangers your careers. Do not delay.
 
To those who were unaware (those who have not read my website page), I hand delivered to D1's office a Public Records Request that read:

"(1)(a)- Every person who has custody of a public record shall permit the record to be inspected and copied by any person desiring to do so, at any reasonable time, under reasonable conditions, and under supervision by the custodian of the public records.
"{ c} - A custodian of public records and his or her designee must acknowledge requests to inspect or copy records promptly and respond to such requests in good faith. A good faith response includes making reasonable efforts to determine from other officers or employees within the agency whether such a record exists and, if so, the location at which the record can be accessed.
"(3)(a)- Any person shall have the right of access to public records for the purpose of making photographs of the record while such record is in the possession, custody, and control of the custodian of public records.
"(4)- The custodian of public records shall furnish a copy or a certified copy of the record upon payment of the fee prescribed by law. If a fee is not prescribed by law, the following fees are authorized:
"(a)1.- Up to 15 cents per one-sided copy for duplicated copies of not more than 14 inches by 81/2 inches;
"2.- No more than an additional 5 cents for each two-sided copy; and
"3.- For all other copies, the actual cost of duplication of the public record.
"(b)- The charge for copies of county maps or aerial photographs supplied by county constitutional officers may also include a reasonable charge for the labor and overhead associated with their duplication.
"( c) - An agency may charge up to $1 per copy for a certified copy of a public record.
"(d)- If the nature or volume of public records requested to be inspected or copied pursuant to this subsection is such as to require extensive use of information technology resources or extensive clerical or supervisory assistance by personnel of the agency involved, or both, the agency may charge, in addition to the actual cost of duplication, a special service charge, which shall be reasonable and shall be based on the cost incurred for such extensive use of information technology resources or the labor cost of the personnel providing the service that is actually incurred by the agency or attributable to the agency for the clerical and supervisory assistance required, or both.

"Under the Florida State Constitution and under FL SS 119, I request that from now on EVERY e-mail that is received at your office from Maureen Elizabeth Rupe, born August 2 1944, of 7185 Bright Ave., Port St. John, FL 32927, no matter what e-mail address it originates from, be immediately forwarded to myself, Linda McKinney, at mckinney6025@bellsouth.net in its entirety without deletion, correction, or omission.

"Since Maureen Elizabeth Rupe has apparently received this service, under the FL Constitution, I demand and have the right to the same service under the law.

Commissioners, as you can see, as of October 4, 2011, I have a standing PRR with the D1 office. I submit the same request to all offices now. To make it a more formal request, I shall send the same request separately to each office (just to satisfy protocol).
 
I remind Comm.. Fisher of our meeting soon after he was sworn in:
 
“I do solemnly swear that I will support, protect, and defend the Constitution and Government of the United States and of the state of Florida: that I am duly qualified to hold office under the Constitution of the state; and that I will well and faithfully perform the duties of  (…office) on which I am now about to enter, So help me God.”
 
Apparently, in your office, this part of the Florida Constitution is not applicable:

In that meeting, Comm. Fisher, you ate candy, played with the candy wrappers and generally let me know you were disinterested in the proof I was offering you that your staff -- England and Lackovitch specifically -- had ignored FL SS 119 on a previous occasion and that it should NOT be allowed to happen again. You said that it wouldn't happen again on your watch. Well, here we are. It has happened again and you, Fisher, have no candy wrappers to hide behind. You have allowed your staff to run the show, and you have been put into an untenable position because of their actions. Don't you feel all that power you have within your own office? Must be so heady!
 
So, Commissioner England, I request my Public Records Request be delivered immediately. Thank your staff for me for their cooperation. I'm sure D1 is in good hands with you.

To which I must respond publicly, as rupester wrote publicly. I wrote a letter in response to the owner of the pooper paper, but I seriously doubt it will appear. So, I publish it here for the benefit of all:

I have searched the BOCC website and cannot find anything that says there was a meeting on August 11, 2011. I have found one for August 2nd and 16th, but not August 11th. Therefore I can neither confirm nor deny the alleged words of Mary Bolin.

However, I would ask you to consider the following:
Andy Anderson, NOT A CPA: he has an A.A., in what it doesn't state.
Mary Bolin, NOT A CPA: she has a B.A. in Education. (Difficult info to find: it's not on her BOCC website Bio.)
Chuck Nelson, NOT A CPA: his degree is (Shock! Surprise!) Phys. Ed.!
Robin Fisher, NOT A CPA: he's a Public Relations major.

So, considering the studies and backgrounds of the other four Commissioners, I think it's reasonable to follow Commissioner Infantini's lead - especially when it comes to money matters -- and go with her recommendations. CPA v rupester and the four Commies? Yeah. Bachelor's Degree, Master's Degree, licensed financial planner, CPA and internal auditor Infantini every time!

September 7, 2022: 4:00 p.m. NOTE: I wrote to the County asking for a copy of the minutes of the August 11, 2011 meeting rupester quotes in her article. The response is below:

"I was forwarded your request for the minutes of the August 11, 2011 Board of County Commissioners meeting. There was no Board meeting held August 11, 2011, however there were three regular meetings in the month of August. If there is particular subject or item you are interested in, we would be happy to research that for you.

So, I sent a request to the pooper paper's owner/publisher/editor that he print a correction in next month's pooper paper. We'll see if he actually does anything about it.

Update: I received the meeting notes from the County for a meeting that happened AUGUST 9, 2011. Contrary to what rupester asserts in her article, Infantini is not accused of the mentioned "sins". Read the meeting notes here. Notice that when Comm. Bolin is speaking, she does NOT mention Comm. Infantini at all. She never mentions any names. She just states that there is misinformation out there. rupester assigning words to Bolin in order to make Infantini look as bad as possible. This, to me, is NOT reporting. rupester is creating a misimpression and is trying to influence people to her way of thinking (as if she actually thinks?).

I have written to the pooper paper's owner and reminded him of rupester's history of proven plagiarism, possible copyright infringement, her assigning words to Bolin and errors in dates and facts. I have asked that from this date forward he label rupester's writings as "OPINION" instead of allowing them to stand as reporting. I have taken journalism and I know the difference between a fact, rhetoric and a hit piece. rupester's every mention of Comm. Infantini is a hit piece filled with rhetoric. I think it's time the pooper paper be held accountable. If you agree with me, write to Happenings and tell them it's time their writer be held accountable to the rules of journalism or have her writing labeled "OPINION". It's time.
